1.0 Purpose and Applicability of this Privacy Policy

This Privacy Policy (the “Privacy Policy” or “Policy”) published by Bioimaging North America (the “Association”) governs the collection, storage and disclosure of your information that you provide to the Association via the Association’s website located at https://www.bioimagingnorthamerica.org (the “Site”). “Service” refers, collectively, to the Site and any of the Association’s services including, but not limited to, features and functionality for users to share information about their facility, equipment, expertise, training resources, job openings and events for greater exposure, and networking and utilization by the broader bioimaging community. The terms “we,” “us,” and “our” refer to the Association. “You” refers to you, as a user of our Site or our Service.

This Policy is designed to help you understand how we collect, use and safeguard the information you provide to us and to assist you in making informed decisions when using the Service. If you do not consent to this collection, storage and disclosure, do not use the Site or Service. We may change the Policy at any time without prior notice, and your continued use of the Site following any change is an agreement by you to the change in the Privacy Policy. 

In addition to this Privacy Policy, your use of the Site and the Service is governed by the Terms of Use (the “Terms of Use”), located at https://www.bioimagingnorthamerica.org/terms/. To fully understand your rights, your obligations, and all conditions applicable to your use of the Site and the Service, please consult the Terms of Use in addition to this Privacy Policy.  

2.0 Information We Collect About You

2.1 Site Visitors

When you visit the Site, we collect the following information (collectively, “Site Visitor Information”):

From You

We collect certain information from you when you provide it to us directly. Specifically:

Join. When you sign up to benefit from certain services offered by the Association, you provide us with your first and last names, your email address which we use to subscribe you to our Newsletter, and other information related to your role in the bioimaging community which we may use to help others in the bioimaging community to connect with you for your services or expertise.

Submit a Posting.  When you submit an event, job, or training/education material, we may collect your name and email to ensure we have a contact person for each submission.

User Support. If you email us at an email address published on our Site with a support request or comments, you may provide us with information such as your contact information and a description of the issue, so that we can respond.

From Your Browser or Device

Whenever you use any online service, certain information is created and logged automatically. The same is true when you visit our Site. Here’s what we collect:

Log. When you visit our Site (whether on your computer or on a mobile device), we gather certain information automatically and store it in log files. This information includes, but may not be limited to, IP addresses, your internet service provider, referring/exit pages, date/time stamps, clickstream data, login/logout times, services used on our site, and duration of time spent on our the Site.

Device. In addition to log data, we collect information about the device you’re using to access the Site. This information includes, but is not limited to, the type of device, browser type, operating system, settings, unique device identifiers, and crash data that helps us understand when something goes wrong.

Cookies. We also use cookies (small text files sent by your computer each time you visit our Site that are unique to your account or your browser) and similar technologies. For example, we use Google Analytics, which places cookies that collect information, which allows us to understand how often you use the Site, where you are accessing the Site from, and events that happen on the Site. You may opt out of Google Analytics here.

2.2 Other Services

We use certain third-party online services to provide information about the Association’s work (like Google, Mailchimp, Airtable, Twitter, Instagram and LinkedIn) (such services, “Other Services”). When you follow, like, comment, or otherwise engage with us through these Other Services, we see the personal data that the Other Service generally makes available about its users (that information, “Other Service Information”). For example, when you comment on our post on an Other Service, that Other Service may attribute your comment to you in a way that others can see (including us). You can check the privacy policy of any Other Service for more information on how it collects, uses, and shares data, including the Other Service Information that may be provided to us. We will not attempt to re-identify you from information provided by Other Services in aggregated or de-identified form.

2.3 Children’s Privacy

The Site and the Service are not intended for anyone under the age of 18. The Site does not knowingly collect or solicit information from anyone under the age of 18, or allow anyone under the age of 18 to sign up for the Service. In the event that we learn that we have gathered personal information from anyone under the age of 18 without the consent of a parent or guardian, we will delete that information as soon as possible. 3.0 Use of Your Data

3.1 Website Visitor Information 

We use the data we collect about visitors to our Site as follows:

To provide and maintain the Site.

We use the information we collect to provide or serve our Site, and maintain and improve the Site, including understanding the content that our visitors find valuable.

To provide information you’ve requested.

We will inform you – via the email address you provide us – of other initiatives, news, events, requests for applications, and job opportunities related to BINA or its Partner Organizations (https://www.bioimagingnorthamerica.org/about/#partners).

To communicate with you.

We may also use your information to directly communicate with you about your use of the Site or to respond to an email or submission from you.

3.2 Other Service Information

We use information from Other Services to understand the particular materials that we posted or linked to that users of those Other Services found most valuable and to inform our marketing/communication efforts.

3.3 Advertising

We may use advertising to promote the products, programs, and services that we provide and/or support. Subject to your settings, we may use your email address or cookies to direct ads for our own programs to you on third-party sites.

4.0 Sharing Your Data

Except in the instances listed below, we will not disclose your personal information to others unless you consent to it, nor will we ever sell your personal information to advertisers or other third parties. However, we share your information in the following ways:

4.1 Third-Party Service Providers

BINA works with vendors and service providers (collectively, “Service Providers”) that help us provide the Site by providing services on our behalf. These services may include, for example, sending emails, performing statistical analysis, database management services, database hosting, providing customer support software, and security. In the course of providing these services, our service providers may have access to your information, including personal information. Providing Service Providers with such access is necessary for the purposes of providing their service.

4.2 Links to Other Sites

As part of the Service, we may provide links to or compatibility with other sites or applications. However, we are not responsible for the privacy practices employed by those websites or the information or content they contain. This Privacy Policy applies solely to information collected by us through the Site and the Service. Therefore, this Privacy Policy does not apply to your use of a third party website accessed by selecting a link on our Site or via our Service. To the extent that you access or use the Service through or on another website or application, then the privacy policy of that other website or application will apply to your access or use of that site or application. We encourage our users to read the privacy statements of other websites before proceeding to use them.

4.3 Legal and Safety Reasons

We may disclose information if we believe in good faith that it’s necessary (a) in connection with any legal investigation; (b) to comply with relevant laws or to respond to subpoenas or warrants served on us; (c) to protect or defend our rights or property or users of the Service or others; and/or (d) to investigate or assist in preventing any violation of the law.

4.4 Partner Entities

We may share your information with our partners, in which case we will require them to honor this Privacy Policy. “Partners” refers to entities partnered with BINA and listed under Partners on our Site (https://www.bioimagingnorthamerica.org/about/#partners). 

5.0 Rights of Users Based in the European Union

If you are based in a jurisdiction governed by the General Data Protection Regulation (GDPR) of the European Union, you have the rights set forth below.

5.1 The Right to Access

You have the right to request copies of your personal data from the Association. We may charge you a small fee for this service.

5.2 The Right to Rectification

You have the right to request that the Association correct any information you believe is inaccurate. You also have the right to request the Association to complete information you believe is incomplete.

5.3 The Right to Erasure

You have the right to request that the Association erase your personal data, under certain conditions. 

5.4 The Right to Restrict Processing

You have the right to request that the Association restrict the processing of your personal data, under certain conditions. 

5.5 The Right to Object to Processing

You have the right to object to the Association’s processing of your personal data, under certain conditions. 

5.6 The Right to Data Portability

You have the right to request that the Association transfer the data that we have collected to another organization, or directly to you, under certain conditions. 

5.7 Making a Request

If you make a request in accordance with your rights as set forth above, we have one month to respond to you. If you would like to exercise any of these rights, please contact us as set forth below. Please note in your request that your request pertains to www.bioimagingnorthamerica.org.

6.0 Retention and Deletion

We will keep your information for as long as we believe that we need it for the purpose for which we collected it (as set forth above) or to meet legal obligations, resolve disputes, maintain security, prevent fraud and abuse, enforce our agreements with you, or fulfill your request to unsubscribe from further messages from us. 

7.0 Data Transfer

BINA is based in the United States. We process data both inside and outside of the United States. When you engage with the Site, you are sending personal data into the United States, which may have different data protection rules than those of your country. Nonetheless, with respect to data of or pertaining to those of our users who are subjects of the European Union, we hereby assert that the terms set forth in Section 5 of this Policy constitute appropriate safeguards under the requirements of Article 46 of the GDPR. 

8.0 Our Lawful Bases

We will collect, use, and share your personal data only where we have a legal right to do so. This section explains our lawful bases for processing personal data, including under GDPR.

Consent. We rely on consent to engage in certain data collection activities, including through cookies.

Legitimate Interests. We rely on legitimate interests to process the data we collect when you browse the Site or use the Service. We process this data based on our legitimate interest in understanding how the Site and Service are being used, and your legitimate interest in accessing the Site and Service.

Where we rely on consent, you have the right to revoke your consent; and where we rely on legitimate interests, you have the right to object by emailing us at contact@bioimagingna.org.

9.0 Other Important Information

9.1 Security of Your Information

Security of personal data is important to us. We implement security safeguards designed to protect your personal data, including reasonable administrative, technical, and physical safeguards designed to protect personal data from unauthorized access, use, alteration, and destruction. Despite these efforts, we cannot guarantee that your data may not be accessed, disclosed, altered, or destroyed by a breach of any of our physical, technical, or administrative safeguards. Please notify us immediately at contact@bioimagingna.org if you become aware of any security issues relating to our Services.

9.2 Your Communications Preferences

The personal information you voluntarily provide to join BINA allows us to keep you updated via our newsletter of announcements, job opportunities, and upcoming events. If you no longer want to be on our mailing lists, you can opt out at any time by updating your preferences. You may update your preferences or request to unsubscribe from our mailing lists by following the directions set forth on the Site or included in any applicable communication. You may also send an email to contact@bioimagingna.org requesting to unsubscribe.

9.3 Do Not Track Signals

We don’t currently share personal data with third parties for their direct marketing purposes, nor do we support any Do Not Track signals since there’s currently no standard for how online services respond to those signals. As standards develop, we may establish policies for responding to Do Not Track signals, which we would describe in this Privacy Policy.

9.4 Changes to This Privacy Policy

We may modify this Privacy Policy from time to time, and you can see when the last update was by looking at the “Last Updated” date at the top of this page. If we make material changes to it, we’ll provide you notice through this Privacy Policy. If you object to any changes, you may stop accessing the Site. Your continued use of the Site  and the Service after we publish a notice about changes to this Privacy Policy means that you acknowledge the updated Privacy Policy following the date it takes effect.

The Association reserves the right to change this policy at any time.  We will notify you of significant changes to our Privacy Policy by placing a prominent notice on the Site. Significant changes will go into effect 30 days following such notification. Non-material changes or clarifications will take effect immediately. You should periodically check the Site and this privacy page for updates.
